9. APPROVAL OF STUDENT PROGRESSION PLANS
Description

Changes have been made to both the Middle School and High School Student Progression Plans with regards to access to Florida Virtual School Courses in alignment with state statue.

10. APPROVAL OF A CONSTRUCTION STAGING LEASE ON A PARCEL OF LAND ADJACENT TO BOOKER HIGH SCHOOL
Description

During the Booker High School rebuild project, it will be necessary to store and stage various construction materials off site.  There is sufficient space for this use on a parcel adjacent to the school site.  The parcel is known as Lot 7, Block E, Amaryllis Park, Sarasota, Florida.



Recommendation
That the School Board approve the contract for the construction staging lease with the adjacent property owner on a parcel known as Lot 7, Block E, Amaryllis Park, Sarasota, Florida.

11. AMENDMENT TO RESOLUTION TO ACQUIRE AN ELEMENTARY SCHOOL SITE IN NORTH PORT
Description
On October 5, 2010, the Board approved the First Resolution, authorizing the acquisition of 92 small parcels for a future elementary school in North Port.  This Amendment excludes three parcels that analysis now shows are not needed for the school site, from the list of parcels authorized for purchase.   

Recommendation
That the School Board approve the Amendment to Resolution of the School Board of Sarasota County, Florida, RE: Acquisition of Property for a Future Elementary School in North Port, Florida.

12. APPROVAL OF FINAL ORDER IN SCHOOL BOARD V. KARIN EHLERS
Description
On November 10, 2010, Division of Administrative Hearings Administrative Law Judge Elizabeth W. McArthur entered a Recommended Order recommending that the Board enter a final order "terminating Respondent, Karin Ehlers's, employment."  Neither party has filed any exceptions to the recommended order.

Recommendation
That the School Board enter a Final Order adopting the Recommended Order of the Administrative Law Judge in DOAH Case Number 10-4142, terminating the employment of Karin Ehlers effective December 7, 2010."

AGREEMENTS/CONTRACTS

13. APPROVAL OF THE TENANT LEASE AGREEMENT BETWEEN THE CITY OF NORTH PORT AND THE SCHOOL BOARD OF SARASOTA COUNTY, FLORIDA, SARASOTA COUNTY TECHNICAL INSTITUTE
Description
This Tenant Lease Agreement is entered into between the City of North Port, a political subdivision in Sarasota County of the State of Florida (Landlord) and Sarasota County Technical Institute (Tenant).  The Tenant desires to be part of the Family Service Center whose mission is to collaboratively integrate private human service providers and governmental entities to provide a multitude of services to the North Port Community. The term of this Lease Agreement shall be for one (1) year commencing on October 1, 2010, and shall terminate on September 30, 2011.  This Lease Agreement may be renewed annually upon the mutual agreement of the parties.   Cost to tenant is zero dollars.

Recommendation

That the Tenant Lease Agreement between the City of North Port and the School Board of Sarasota County, Florida, Sarasota County Technical Institute be approved.

14. APPROVAL OF THE AGREEMENT BETWEEN THE SCHOOL BOARD OF SARASOTA COUNTY, FLORIDA, AND MANOR CARE VENICE, FLORIDA
Description

Whereas, School Board offers to enrolled students a Health Science program; and whereas, Health Care Facility manages a health care facility; and whereas, School Board desires to provide to its students a clinical learning experience through the application of knowledge and clinical skills in actual patient-centered situations in a health care facility; and whereas, Health Care Facility has agreed to make its facility available to School Board for such purposes.  School Board shall be responsible for the implementation and operation of the clinical component of its program ("Program") at Health Care Facility, which Program shall be approved in advance by Health Care Facility.  The initial term of this agreement shall be for three years, commencing September 22, 2010, expiring August 1, 2013, unless otherwise terminated as provided herein.



Recommendation
That the agreement between the School Board of Sarasota County, Florida and Manor Care, Venice, Florida, be approved.

15. APPROVAL OF THE CONTRACT BETWEEN SARASOTA COUNTY AND THE SCHOOL BOARD OF SARASOTA COUNTY, FLORIDA (SARASOTA COUNTY TECHNICAL INSTITUTE)
Description

The School Board of Sarasota County, Florida, (Sarasota County Technical Institute) will provide to Sarasota County, Workforce Readiness Classes for VIP-ER Program Participants and General Education Development (GED) classes for VIP-ER Program participants.



Recommendation
That the agreement between Sarasota County and the School Board of Sarasota County, Florida, (Sarasota County Technical Institute) be approved.

16. APPROVAL OF THE CONTRACT FOR JUVENILE JUSTICE CONSULTANT SERVICES BETWEEN THE SCHOOL BOARD OF SARASOTA COUNTY, FLORIDA, AND MARGARET HUGHES
Description
Margaret Hughes, the Juvenile Justice Consultant will consult with the Sarasota County schools and will provide professional development and inservice trainings to teachers, staff and administrators for the mental health grant, "Connections 4 Healthy Students."

Recommendation
That the contract for consultant services between the School Board of Sarasota County, Florida, and Margaret Hughes in the amount of $38,400, be approved as presented.

GRANTS

17. APPROVAL OF THE CAREER ACADEMY MATCHING GRANT PROPOSAL TO THE STEM ACADEMY FOR NORTH PORT HIGH SCHOOL AND BOOKER HIGH SCHOOL
Description

COMPETITIVE:  Grant funds of $50,000 will be used to purchase equipment and software necessary to implement curriculum provided by The STEM Academy to develop new career academies at North Port and Booker High Schools.



Recommendation
That the School Board of Sarasota County approve the Career Academy Matching Grant.

EXPULSIONS

18. APPROVAL OF EXPULSION CASE NO. 10-473
Description
The student listed in Expulsion Case No. 10-473, is in violation of an accepted Expulsion Settlement Agreement for alternative school placement.  On April 23, 2010, the student listed in Expulsion Case No. 10-473, violated School Board Policy 5.34(1)(g), Disobedience/Insubordination/Profanity.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until June 4, 2011.

Recommendation
That in accordance with provisions of Sections 1006.07(1)(a)(b), Florida Statutes and School Board Policy 5.34, the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 10-473, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately for the remainder of the 2010-2011 academic year.

Description

The student listed in Expulsion Case No. 11-051, is in violation of an accepted Expulsion Settlement Agreement for alternative school placement.  On October 5, 2010, the student listed in Expulsion Case No. 11-051, violated School Board Policy 5.34(1)(d), Battery on Another Student.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until August 22, 2011.

Description

Description
The student listed in Expulsion Case No. 11-168, is in violation of an accepted Deferred Expulsion Agreement for school placement.  On October 19, 2010, the student listed in Case No. 11-168, violated School Board Policy 5.34(1)(g), Repetitive Disruptive/Threatening Behaviors.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until June 6, 2011.

Description
The student listed in Expulsion Case No. 11-159, is in violation of an accepted Expulsion Settlement Agreement for alternative school placement.  On October 25, 2010, the student listed in Expulsion Case No. 11-159, violated School Board Policy 5.32, Zero Tolerance and School Board Policy 5.322, Prohibition Against Use, Sale, or Possession of Alcohol or Drugs.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until June 15, 2012.

Recommendation
That in accordance with provisions of Sections 1006.07(1)(a)(b), Florida Statutes and School Board Policy 5.34, the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 11-159, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately for the remainder of the 2010-2011 academic year, the 2011 summer session, and the entire 2011-2012 academic year.

24. APPROVAL OF EXPULSION CASE NO. 11-170
Description

On November 3, 2010, the student listed in Expulsion Case No. 11-170, violated School  Board Policy 5.32, Zero Tolerance and School Board Policy 5.321, Possession of Weapons and Other Prohibited Articles.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until June 15, 2012.



Recommendation
That in accordance with provisions of Sections 1006.07(1)(a)(b), Florida Statutes and School Board Policy 5.34, and the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 11-170, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately for the remainder of the 2010-2011 academic year, the 2011 summer session, until June 15 of the 2011-2012 academic year.

25. APPROVAL OF EXPULSION CASE NO. 11-160
Description

Description

On November 8, 2010, the student listed in Expulsion Case No. 11-156, violated School Board Policy 5.34(1)(g), Repetitive Inappropriate Activity.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until January 14, 2012.



Recommendation
That in accordance with provisions of Sections 1006.07(1)(a)(b), Florida Statutes and School Board Policy 5.34, and the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 11-156, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately for the remainder of the 2010-2011 academic year, the 2011 summer session, until January 14, of the 2011-2012 academic year.

27. APPROVAL OF EXPULSION CASE NO. 10-269
Description
Board Policy 5.34(4), permits the Board to hold in abeyance the expulsion of a student if the student participates in a recognized alternative-to-expulsion program.  This student has been withdrawn from the Triad program and the expulsion reinstated due to non-attendance.

Recommendation
That the abeyance of Expulsion Case No. 10-269, be rescinded per School Board Policy 5.34(4).

MATERIALS MANAGEMENT

30. APPROVAL OF CLASSIFICATION OF INOPERATIVE EQUIPMENT AND FURNITURE AS PROPERTY TO BE DELETED
Description
The custodians of the property (cost center heads) have certified it to be traded in on new equipment, unaccounted for, not repairable or otherwise inoperable.  Property still on hand after reallocation will be salvaged for any useful parts and then sold at auction.

Recommendation
That the classification of equipment and furniture, as property to be deleted, be approved.

CONSTRUCTION

31. APPROVAL OF ARCHITECT'S CONTRACT FOR THE LAUREL NOKOMIS HVAC RENOVATION PROJECT
Description
The scope of work shall include design and construction administration services to renovate the HVAC systems including new chiller(s) and pumps, thermal energy storage system, piping, air side systems, and electrical distribution system at the referenced campus.  Also included is the sealing of the perimeter of the attic space with an air barrier to create a non-ventilated attic, paint, carpet and paving.  On November 9, 2010, the Director of Construction Services met with a representative of TOTeMS Architecture, Inc., and successfully negotiated a contract.  The amount of this contract is $763,300.00.  These contract documents have been approved by the School Board attorney and are available for review at the Construction Services Department.  The project budget is $10,000,000.00.  Funds for this project are available in the capital budget account.      

Recommendation
That the architect's contract for the Laurel Nokomis HVAC Renovation project be approved as presented.

32. APPROVAL OF AUTHORIZATION TO NEGOTIATE A CONTRACT WITH TOTeMS ARCHITECTURE, INC., FOR THE REUSE OF THEIR LAUREL NOKOMIS HVAC RENOVATION DESIGN FOR THE SARASOTA MIDDLE SCHOOL HVAC RENOVATION PROJECT
Description
The design for the Sarasota Middle School HVAC Renovation project will be based on the Laurel Nokomis School HVAC Renovation project.  Accordingly, pursuant to Florida Statutes 1013.45(4) and 287.055(10), the Board is authorized to purchase the architectural services of TOTeMS Architecture, Inc., the firm under contract with the Board for the Laurel Nokomis HVAC Renovation project.  The purchase of the referenced architectural services is to the economic advantage of the Board and the services conform to the standards prescribed by the rules of the State Board of Education.  The project budget is approximately $10,000,000.00.  Funds for this project are available in the capital budget account.

Recommendation
That the Director of Construction Services be authorized to negotiate a contract with TOTeMS Architecture, Inc., for the reuse of their Laurel Nokomis HVAC Renovation design for the Sarasota Middle School Renovation project.

33. ACCEPTANCE OF CONSTRUCTION SERVICES' PROJECT(S) COMPLETION AND APPROVAL OF FINAL PAYMENT TO CONTRACTOR(S)
Description

The substantial completion date(s), original and final contract amount(s) are summarized on the enclosure for ease for review.  All work has been completed and all required close-out-documents have been received from the contractor.  The Director of Construction Services has determined that the project(s) are complete in accordance with state statutes.



Recommendation
That the cited Construction Services' project(s) be accepted as complete and the final payment to contractor(s) be approved as presented.

34. APPROVAL OF ENCROACHMENT AGREEMENT AT BOOKER HIGH SCHOOL BETWEEN THE SCHOOL BOARD OF SARASOTA COUNTY, FLORIDA, AND THE CITY OF SARASOTA
Description

This agreement grants the School Board of Sarasota County permission to utilize a portion of the public right-of-way known as Orange Avenue located adjacent to the real property known as School Board of Sarasota County for the purpose of allowing the installation of four 4" PVC conduit sleeves for the irrigation, power and other SCSB utilities crossing relocated Orange Avenue.  This agreement has been approved by the School Board attorney.



Recommendation
That the Encroachment Agreement at Booker High School between the School Board of Sarasota County, Florida, and the City of Sarasota, be approved as presented.

35. APPROVAL TO DECLARE PROPERTY AS SURPLUS
Description

The rebuild of Booker High School, including the rerouting of Orange Avenue, will require a series of street vacations, transfers of properties, and vacations of easements.  This item declares four parcels of the current Booker High School campus as surplus, allowing for future Board actions that will allow property transfers with the City of Sarasota and with Sarasota County.  In accordance with section 1.4(7)(d) of the Guidelines of the State Requirements for Educational Facilities, and with section 274.05, Florida Statutes, district staff has determined that the parcels are not needed for instructional or ancillary support functions.  More importantly, these eventual transfers will help improve Orange Avenue and Myrtle Street, to the benefit of the school and the community.



Recommendation
That the School Board declare the four parcels, as presented in the attachment, to be surplus property.

36. APPROVAL OF QUIT CLAIM DEED TO THE CITY OF SARASOTA FOR THE NEW ORANGE AVENUE RIGHT OF WAY
Description
The construction of the rerouted Orange Avenue Phase I of the Booker High School rebuild will be completed in late December.  The dedication of the new road will be in early January at a City of Sarasota Commission meeting.  In addition, at the same meeting the City of Sarasota will be vacating the existing Orange Avenue right of way which will then become the property of the School Board of Sarasota County. 

Recommendation
That the School Board approve the quit claim deed to the City of Sarasota for Orange Avenue right of way.

The Superintendent's Financial Statements for the month ending September 30, 2010, does not reflect any unexpected trends at this early stage in the 2010-2011 fiscal year.  The negative trend in the General Fund is to be expected as the District does not receive their main funding source, property taxes revenues, until late November.  However, the deficit spending in the General Fund will continue as fund balance has been budgeted to decrease this fiscal year due to State revenue shortfalls and reduced property tax revenues.  The Food Service Fund shows a large increase in expenditures.  This is caused by adjustments made to account for changes in inventory balances.  Revenue received from the National School Lunch Program continues to increase in the Food Service Fund as the economy continues to be volatile.  The Capital Projects Fund reflects the proceeds received from the Certificates of Participation, Series 2010A (Qualified School Construction Bonds) and Certificates of Participation, Series 2010B.

39. TO APPROVE THE CAPITAL AND SPECIAL REVENUE FUND BUDGET AMENDMENTS
Description

The Capital Fund Budget Amendment is to amend the budget for the final year-end project carry forwards and the sale of the COP's and QSCB's.

The Special Revenue Fund Budget Amendment amends the budget for the actual grant awards received through November 2010.



Recommendation
That the Budget Amendments for the Capital Fund and the Special Revenue Fund be approved as presented.

40. SECOND RESOLUTION TO ACQUIRE AN ELEMENTARY SCHOOL SITE IN NORTH PORT
Description
On October 5, 2010, the Board approved the First Resolution, authorizing the acquisition of numerous small parcels for a future elementary school in North Port.  This Second Resolution approves the initial batch of contracts for this acquisition.

Recommendation
That the School Board approve the Second Resolution of the School Board of Sarasota County, Florida, RE: Acquisition of Property for a Future Elementary School in North Port, Florida.
